SituFix Ventures LLC, a California limited liability company, owner and operator of HomeFixated.com (“Company,” “We,” “Us,” or “Our”), respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. Section 512 (the “DMCA”), the Company will respond promptly to claims of copyright infringement committed using the Website located at https://www.HomeFixated.com (the “Website”) that are reported to the Company’s designated Copyright Agent identified below.

Repeat Infringer Policy
The Company maintains a policy that provides for the termination, in appropriate circumstances, of users and account holders who are repeat infringers of copyright. The Company may, in its sole discretion, limit access to the Website or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.
Copyright Infringement Notification
If You are a copyright owner or an agent authorized to act on behalf of a copyright owner, and You believe that any content on the Website infringes upon Your copyrights, You may submit a notification pursuant to the DMCA by providing the Company’s designated Copyright Agent with a written notice containing all of the following (please consult Your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material (providing URLs in the body of Your communication is the most effective way to help us locate content promptly);
- Information reasonably sufficient to permit the Company to contact the complaining party, such as a mailing address, telephone number, and, if available, an email address;
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification
If You believe that content You submitted to the Website was removed or access to it was disabled as a result of mistake or misidentification, You may file a counter-notification with the Company’s Copyright Agent. Please understand that filing a counter-notification may lead to legal proceedings between You and the complaining party to determine ownership of the material. Be aware that there may be adverse legal consequences if You make a false or bad faith allegation through this process. If You are not certain whether certain material infringes the copyrights of others, we strongly recommend that You consult an attorney before filing a counter-notification.
A counter-notification must be in writing and must include all of the following:
- Identification of the specific URLs or other locations of material that the Company has removed or to which the Company has disabled access;
- Your full name, mailing address, telephone number, email address, and, if applicable, Your username on the Website;
- The following statement: “I consent to the jurisdiction of the Federal District Court for the judicial district in which SituFix Ventures LLC is located, and will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
- The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
- Your physical or electronic signature (a scanned physical signature or a valid electronic signature will be accepted).
The Company can only accept a counter-notification directly from the user whose content has been removed or disabled. For verification purposes, counter-notifications must be submitted from the email address associated with the user’s account, where applicable. For purposes of this DMCA Policy, a “user” means anyone who, along with their submitted material, provides the Company with their name, email address, telephone number, or any other identifying information that would allow the Company to contact the person directly.
Send the written counter-notification to the Company’s designated Copyright Agent at the address listed above, with the words “DMCA Counter-Notice” in the subject line.
Upon receipt of a valid counter-notification, the Company may forward a copy to the original complaining party, informing that person that the Company may replace the removed content or restore access to it in ten (10) business days. Unless the copyright owner files an action seeking a court order against the content provider, user, or member within ten (10) business days of receiving the counter-notification, the removed content may be replaced or access to it restored within ten (10) to fourteen (14) business days (or longer) after receipt of the counter-notification, at the Company’s sole discretion.
